Terms of Service

These Terms of Service (“Terms”) govern your access to and use of The Fifth Tutor (the “Service”), a website at fifthtutor.com operated by RayRay Labs (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About the Service

The Fifth Tutor is a search, discovery, and deck-building tool for the trading card game Magic: The Gathering. The Service is provided for personal, non-commercial use. We are not affiliated with, endorsed by, or sponsored by Wizards of the Coast LLC. Magic: The Gathering and all related names, marks, and card text are trademarks or copyrights of Wizards of the Coast LLC. We display card information under fair-use principles for the purpose of catalog, deck-building, and analysis tools.

2. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you may only use the Service with the consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

3. Accounts

Some features (deck building, saved lists, AI-assisted tools) require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating an account and to keep it up to date. We may suspend or terminate an account that violates these Terms or that we reasonably believe is being used for abuse, fraud, scraping, or other prohibited purposes.

4. Acceptable Use

You agree not to:

• Use any automated means (bots, scrapers, crawlers) to access the Service or its API beyond what robots.txt or rate limits permit, or to bulk-extract our derived data (synergy rankings, scores, embeddings, predicate data).
• Reverse engineer, decompile, or attempt to extract source code from the Service, except to the extent such restriction is prohibited by applicable law.
• Reproduce or republish substantial portions of our derived data (the FT Power rankings, synergy graph, similar-card calculations) without prior written permission.
• Interfere with or disrupt the Service, attempt to circumvent any access controls, or probe for vulnerabilities without our explicit authorization.
• Use the Service to harass other users, post unlawful content, or violate any applicable laws or third-party rights.

5. User Content

If you create or import decks, lists, comments, or any other content through the Service (“User Content”), you retain ownership of your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and otherwise use the User Content as necessary to operate and improve the Service. You represent that you have the right to submit any User Content you upload and that it does not infringe on any third-party rights.

6. Imported Decklists and Provenance

The Service may display tournament results, published decklists, and other publicly available deck data alongside provenance (source, event, date). These imports are presented for reference and analysis under fair-use principles. If you are the original author of an imported deck and would like it removed or attribution corrected, contact us at support@fifthtutor.com.

7. Intellectual Property

The Service's code, design, derived analytical data, and original content are owned by RayRay Labs and protected by copyright, trademark, and other intellectual-property laws. Card names, card text, mana symbols, and associated artwork are the property of Wizards of the Coast LLC.

8. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not guarantee that the synergy rankings, power scores, combo suggestions, or other derived data are accurate, complete, or suitable for any particular purpose. Use at your own discretion.

9. Limitation of Liability

To the maximum extent permitted by law, RayRay Labs and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service. Our total cumulative liability for any claim arising out of or related to the Service is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $50.00.

10. Indemnification

You agree to indemnify and hold harmless RayRay Labs and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your violation of these Terms, your User Content, or your misuse of the Service.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we reasonably believe violates these Terms or is harmful to other users, third parties, or our legitimate interests. You may stop using the Service at any time. Sections that by their nature should survive termination will survive (including ownership, disclaimers, limitations of liability, and indemnification).

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for material changes, take reasonable steps to notify you (for example, via an in-app notice or email to the address associated with your account). Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict-of- laws principles. Any disputes arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in the State of California, United States, and you consent to the personal jurisdiction of those courts.
